Constitution By Laws

Preamble

 
      We, the High School Student Supreme Council Officers, as the highest student governing body of the High School Department, invoke the guidance of our almighty God in order to establish a functional organization that shall embody the aspirations and locals of the high school student body and the significance of the students and welfare that will provide avenues for unity and peace, do hereby ordain and promulgate this constitution and by-laws.
 
ARTICLE 1
 
Name and Domicile of the Organization
SECTION 1. The name of this organization shall be officially known as the “High School Student Supreme Council” (HSSSC).
SECTION 2. The name of this organization shall be the name use to register the organization to the department of high school organizations. The names and charters of all other organizations is affiliated will be attached to this constitution in an appendix.
SECTION 3. The High School Student Supreme Council shall have its domicile and principal office located at APS – 305A at Holy Angel University, Angeles City.
 
ARTICLE II
 
Establishment and Operation
SECTION 1. It was stated in the High School Student Manual, under Article III of the student activity program section B.1 on the guidelines of the student organizations, that the University recognizes the importance of developing creative and responsible student leaders who will eventually assume the mantle of leadership by their chosen field of endeavor. For this purpose, the university seeks to encourage the formatting of student groups who will pursue clearly, established common objectives and initiation of directed endeavors set up along social, recreational, cultural, religious, literary and educational lives.
SECTION 2. The establishment and operation of student organizations in the high school department are governed by the rules and regulations established by the ministry order no. 41, series 1985 on the guidelines governing organizations.
 
ARTICLE III
 
Purpose and Mission Statement
The High School Student Supreme Council (HSSSC) is an independent organization and the highest governing student body of the high school department composed of officers duly elected by the high school studentry in a general elections. As its main purpose, it envisions itself to embody the aspirations and ideals of the whole high school populace and the significance of the students’ rights and welfare. Additionally, the high school student supreme council shall fulfill the following objectives enumerated below:
SECTION 1. The high school student supreme council shall fulfill the need for unity, cooperation and understanding to the whole high school society.
SECTION 2. The high school student supreme council shall renounce all unjustifiable acts that shall disrupt the normalcy, peace and order of the high school department.
SECTION 3. The high school student supreme council shall take emerge of all scholastic activities that require organizational attention.
SECTION 4. The high school student supreme council shall guarantee equal opportunities and treatment to all of its members.
SECTION 5. The high school student supreme council shall recognize the importance of developing creative, productive, outstanding and responsible leaders of its circle.
SECTION 6. The high school student supreme council shall adopt the generally accepted principles of the Holy Angel University High School Department to be part of its laws.
 
ARTICLE IV
 
High School Students Supreme Council Logo
SECTION 1. The High School Student Supreme Council logo shall be used to register the organization to the department of high school organizations. The HSSSC logo shall serve as an emblem of recognition for it is the highest governing student body.
 
ARTICLE V
 
High School Student Supreme Council Election Code
General Provisions:
SECTION 1. TITLE. This code shall be known as the Holy Angel University High School Student Election Code.
SECTION 2. JURISDICTION. This code shall govern HS Student Supreme Council Election.
SECTION 3. OBJECTIVES. This code has the following objectives:
  • To ensure orderly and coordinating elections;
  • To regulate election expenses;
  • To set guidelines / qualification of elections and candidates for elective positions.
Election Positions:
SECTION 4. The elective positions for the HS Student Supreme Council are:
  • Chairman
  • Vice-Chairman
  • Secretary
  • Treasurer
  • Four Representatives per year level
SECTION 5. The duly elected officers of the HS Student Supreme Council shall hold office for one school year excluding summer term. Term of the office of the HS Supreme Council Officers shall commence from the proclamation to the time next set of officers have been officially declared.
Political Party, Qualifications of Candidates and Certificate of Candidacy:
SECTION 6. POLITICAL PARTY. Refers to a group of High School Students united by a common goal.
SECTION 7. QUALIFICATIONS OF CANDIDATES. A candidate for the HS Student Supreme Council shall have the following qualifications:
  • Must be a regular student (without any back subject/deficiency)
  • Must not have been subjected to disciplinary measure(no undertaking signed).
SECTION 8. CERTIFICATE OF CANDIDACY. A certificate of candidacy must be filed before any subject is allowed to run for any position. Filing of the cerficate of candidacy should be within the period of time set by the Electoral Board.
SECTION 9. CONTENTS OF THE CERTIFICATE OF CANDIDACY.
  • The legal name of the student filing the certificate of candidacy;
  • The position he/she is running for;
  • The party to which he/she belongs;
  • The date of filing.
SECTION 10. FILING OF CERTIFICATE OF CANDIDACY. The certificate of candidacy will be filed by the candidate himself/herself not later than the day prescribed by the High School Electoral Board.
SECTION 11. QUALIFICATIONS OF VOTERS. A bona fide HAU high school student is qualified to vote.
SECTION 12. Composition of the High School Student Electoral Board.
  • Administrative Affairs Officer – executive official / chairman
  • Two (2) Activity Coordinators – member
  • Four (4) Guidance Counselors – member
  • Two (2) Edukasyong Pagpapahalaga Faculty – member
SECTION 13. Functions of the HS – SEB
  • Process certificates of candidacy.
  • Screen election campaign materials (e.g. posters, leaflets, streamers, etc.)
  • Supervise conduct of elections.
  • Canvass election returns.
  • Proclaim winning candidates.
Election Campaign and Materials:
SECTION 14. CAMPAIGN PERIOD
  • A week before the elections, candidates may start posting their election campaign materials at places designated by the HSSEB.
  • Room to room campaign is not allowed.
SECTION 15. CAMPAIGN MATERIALS. The following campaign materials are allowed:
  • Posters leaflets
  • One (1) streamer
  • Sample ballots *Writings on the walls, boards / blackboards are prohibited. This could be a ground for disqualification of the candidates.
SECTION 16. MITING DE AVANCE. Miting de Avance will be scheduled during the assigned time for every year level to give students opportunity to assess the candidates. Candidates are prohibited from using vulgar languages and making derogatory remarks / accusations during the campaign. The electoral board shall have the authority to warn and penalize non-conforming candidates.
Election:
SECTION 17. The regular elections for the HAU HS Student Supreme Council will be held every second or third Friday of July.
SECTION 18. ELECTION TIME / PRECINTS. The election is held during advisory period at respective homerooms.
SECTION 19. ELECTION PROCEDURES. The election procedures are as follows:
  • Campaigning on the day of the election either by the candidates or supporters is not allowed.
  • Block voting is considered invalid.
  • Year level representatives will only be elected by the year level they are representing.
  • Class advisers will take charge of the elections.

SECTION 20. The following will be considered valid vote:

  • If the family name is correct but the first name is wrong (provided that no two or more candidates have the same family names for the same position)
  • If only the family name is written (provided that no two or more candidates have the same family names for the same position).
  • If the family name slightly misspelled (provided it is the faculty/adviser’s judgment that the same refers to the specific candidates and to no one else).
The following will be considered invalid vote:
  • If the first name only is written.
  • If the family name or full name is written on the wrong position.
  • If only the Party Name is written.
Canvassing of Votes:
SECTION 21. COUNTING OF BALLOTS. Immediately after voting in the classroom, the class adviser collects and tallies all ballots. Class adviser and class president sign the tally sheet, used and unused ballots are placed in the envelop which is surrendered to the electoral board at the guidance office or at the activity coordinators’ office at APS-205A.
SECTION 22. CANVASSING OF VOTES. As soon as all envelops containing election paraphernalia are surrendered, the electoral board shall start the canvassing of votes.
SECTION 23. BREAKING THE TIE. In case of tie in the position of Chairman, special election shall be conducted by the electoral board; the date of which will be set as soon as possible. Any tie in the slots for the Vice Chairman, Secretary, Treasurer and Representatives, the candidates be proclaimed winners in the said election.
SECTION 24. TABULATING OF ELECTION RETURNS. Electoral Board shall tabulate the election returns.
SECTION 25. OVER-ALL REPORT. The Electoral Board shall submit the over-all report regarding HS Student Supreme Council Elections results which contains:
  • The names of candidates.
  • The number of votes received by each candidate.
  • Questions raised (if any) and solution/decisions made by the electoral board.
Proclamation of Winning Candidates:
SECTION 26. PROCLAMATION. The electoral board shall proclaim the winning candidates for the HS Student Supreme Council Elections upon completion of the election results.
 
ARTICLE VI
 
Term of Office
SECTION 1. The duly elected officers of the HS Student Supreme Council shall serve for one academic year and may be reelected for the next and additional academic year.
 
ARTICLE VII
 
Duties and Responsibilities and Structural Hierarchy
SECTION 1. THE CHAIRMAN. He/she is the chief executive of the HS Student Supreme Council. He/she shall:
  • Supervise and direct HSSSC and monitors the duties and responsibilities of each officer are fulfilled.
  • Preside at all organization meetings and the gathering of the HSSSC.
  • Be responsible for all transactions done by the various HS accredited organizations.
  • Submit a summary of the HSSSC activities during his/her incumbency.
  • Represent the student populace.
  • Coordinate with the activity coordinators concerning the HSSSC activities.
SECTION 2. THE VICE CHAIRMAN. He/she shall:
  • Be responsible for HSSSC internal and external affairs.
  • Work with the Chairman in managing the HSSSC activities.
  • Assume the responsibilities of the chairman and the HSSSC in official situations required.
  • Assist the chairman in any way the chairman requests.
  • Perform miscellaneous duties as needed.
SECTION 3. THE SECRETARY. He/she shall:
  • Be custodian of all records and documents pertaining to HSSSC and its activities.
  • Record the minute of all meetings and keep a file of them.
  • Prepare the agenda for the meetings called by the chairman and inform all officers about the meeting.
  • Submit a monthly report of the activities of the HSSSC in coordination with the Chairman.
  • Assist the Chairman in any way the he/she requests.
  • Perform miscellaneous duties as needed.
SECTION 4. THE TREASUERS. He/she shall:
  • Undertake the collection of all fees and funds of the HSSSC.
  • Be responsible for balancing and maintaining all HSSSC accounts.
  • Keep track of all HSSSC’s assets.
  • Examine and credits all accounts pertaining to the receipts and contributions of fund from all sources of HSSSC.
  • Audit in accordance with the established auditing procedures and all expenditures of HSSSC.
  • Bring to the attention of HSSSC all expenditures which in his/her opinion are irregular, unnecessary, excessive or extravagant.
  • Assist the Chairman in any way the he/she requests.
  • Perform miscellaneous duties as needed.
SECTION 5. THE YEAR LEVEL REPRESENTATIVES. They shall:
  • Meet the officers belonging to their year level.
  • Represent the year level where they belong.
  • Perform such other duties that the HSSSC chairman may delegate to them.
SECTION 6. The following officers have already been establishes. Positions along with a brief description are listed as they fall from highest to lowest rank.
SECTION 7. In the case of general disagreement between officers and/or members may call for a general vote to settle the dispute. This acts as a sort of balances so that no member or officer can abuse his/her power simply by being in the upper rank in the HSSSC structural hierarchy.
SECTION 8. The following is the structural hierarchy of the positions in the HSSSC. It ranges from highest to lowest:
  • Chairman
  • Vice Chairman
  • Secretary
  • Treasurer
  • Four Year Level Representatives for each year level.
This is not to promote strict division between officers but to promote efficiency in official tasks and in questionable matters.
 
ARTICLE VIII
 
The Adviser/s
SECTION 1. The HSSSC Adviser/s must be a full time faculty or staff member employed by the university in the high school department.
SECTION 2. The HSSSC adviser shall advice on the property and constitutionality of the proposed activities and projects of the HSSSC. However, the HSSSC places no additional constraints or burdens upon the adviser. The adviser may have little or as much interactions with HSSSC as they wish provided that he/she will fulfill his/her duties and responsibilities in supervising the HSSSC.
SECTION 3. The HSSSC adviser has the rights of voice, events and access.
 
ARTICLE VIX
 
Meetings
SECTION 1. The HSSSC shall hold a regular meeting every Friday and will typically last anytime from forty five minutes to an hour.
SECTION 2. Meetings are set up as a group forum for discussion.
SECTION 3. At the meetings, officers will relate any concerns, needs, status reports, etc. to the group feedback.
SECTION 4. The Chairman, or Vice Chairman as the case may be will act as arbitrator for the group’s discussion.
SECTION 5. After the officers have presented their information, the meeting will be further opened to get any general group discussion. This may include complaints, suggestions, or general talk about a specific topic. In this way, the purpose of the meeting is not only to keep the HSSSC functioning smoothly but also to provide a forum for general topics.
 
ARTICLE X
 
HSSSC Policies and Procedures
SECTION 1. The HSSSC shall abide by all applicable rules and regulations of Holy Angel University and under the privileges as granted by the High School Activity Coordinators.
SECTION 2. The HSSSC constitution and by-laws will be available to any members and to the High School Department.
SECTION 3. Every member, as stated below shall follow other policies of the HSSSC:
  • HSSSC officers must not forget his/her obligations on his/her studies as well as to God.
  • Gross acts of disrespect in words and in deeds which tend to put any officer in ridicule/contempt is not tolerated.
  • Courtesy and due respect for authority must be observed when dealing with fellow officers.
 
ARTICLE XI
 
Oath of Office of the HSSSC
SECTION 1. It shall be the duty and responsibility of every member of the HSSSC to be loyal to the organization to contribute for its development uphold the constitution and obey the laws and to preserved a just and orderly organization.
SECTION 2. It shall be the duty and responsibility of every officer to contribute time and effort for the success of all undertaking, projects, and other activities of the HSSSC.
SECTION 3. It shall be the duty and responsibility of every officer to submit himself/herself to the will of majority.
SECTION 4. It shall be the duty and responsibility of every member to protect and preserved the properties of the organization and of the university.
SECTION 5. It shall be the duty and responsibility of every officer to pay the Students’ Organization Fee.
 
ARTICLE XII
 
HSSSC Financial Resources
SECTION 1. The general fund of the Council shall consist of the membership fee collected once a student enrolled in the high school department amounting to 75 pesos per student for the whole academic year.
SECTION 2. All funds of the HSSSC shall be kept in full confidentiality in a reputable banking institution within the municipality.
SECTION 3. Dues amounting to 5 pesos shall be collected to every member in every meeting.
SECTION 4. All withdrawals and disbursements of funds shall be put on record bearing the signature of the HSSSC Chairman, Treasurer and noted by the advisers.
 
ARTICLE XIII
 
Amending the By-Laws
SECTION 1. An amendment shall be defined as any change to this constitution that is appended in this section. A revision shall be defined as any change to this constitution which modifies its original structure in part or in whole.
SECTION 2. Amendments and revisions to this constitution may be introduced from the floor by any member and must be submitted to the secretary in writing at the general meeting.
SECTION 3. In order to amend the by-laws, the following must happen:
  • A written document of the amendment will be presented to the four major positions before it is presented to the other officers.
  • The amendment must be approved by a 2/3 majority rule of all HSSSC officers.
SECTION 4. All amendments must be submitted in triplicate to the HSSSC, signed by the authors and must be no more than 15,000 words in length. Upon meeting these conditions, the high school student supreme council will convene and query the document and its authors. One copy will be submitted to the high school department. One copy will be submitted to the high school department, the HSSSC will keep the second and the third will be relegated to a file drawer for posterity.
 
ARTICLE IV
 
Affiliation Policy
SECTION 1. As recognized organization of Holy Angel University, under student government in the High School Department, we are fully acknowledge that we are not allowed to enter any contractual obligation with any outside organizations.
